Lawsuit filed against Scott Perry calls for his removal from Pa. ballots

A lawsuit filed by a Harrisburg-area activist aims to remove House Rep. Scott Perry from 2024 ballots.

PENNSYLVANIA, USA — A Harrisburg-area activist is arguing that Scott Perry should be removed from the upcoming 2024 election ballots for violating the 14th Amendment.

Gene Stilp filed a lawsuit in the Pa. Commonwealth Court against Scott Perry on Jan. 2, which states that the 14th Amendment's instruction clause was violated by Perry.

The 14th Amendment, Section Three states: "No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."

According to the lawsuit, Perry was a "leading proponent of using the Jan. 6, 2021, Congressional presidential election certification process to disrupt the transfer of presidential administrations from Trump to Biden."

Additionally, the lawsuit argues that Perry helped push conspiracy theories that had to do with the validity of the 2020 presidential outcome and was involved with various other officials trying to change the overall narrative of the results.

At this time, Perry has not been formally charged with anything related to the Jan. 6 insurrection, although a judge recently ruled that his texts can be used in the ongoing investigation.

The lawsuit asks for all information regarding possible criminal activity by Scott Perry or any other party to be referred to the Pa. Attorney General for prosecution. 

FOX43 reached out to Perry's office for comment and Perry's campaign spokesman sent the following statement: 

"Congressman Perry is focused on critical problems facing south central Pennsylvania and our Nation, which is why he’s traveling with the Speaker of the House today to examine the ongoing crisis at our southern border. This is a frivolous lawsuit filed by a fringe activist whose claim to fame is an inflatable pink pig.
