Bill Cosby case: Judge says prosecution can go forward

MONTGOMERY COUNTY, PA — Comedian Bill Cosby back in court Thursday.

The 78-year-old comedian walked up to the courthouse in Montgomery County while holding the arm of his spokesman.

This is the latest hearing in the sexual assault case against him in Pennsylvania.

Lawyers for Cosby asked a judge to throw out charges leveled by the Montgomery County District Attorney, saying Cosby drugged and assaulted Andrea Constand at his philadelphia-area home in 2004.

His lawyers argued that Constand should have been required to testify at a preliminary hearing in may and face cross-examination.

At that May hearing, the statement Constand made to the authorities about the incident with Cosby was read in court by a law enforcement witness who was present while she made parts of her statement.

She was not in court that day.

The judge denied Cosby’s effort to compel Constand to testify before trial and ruled there was enough evidence to move to trial.

In Pennsylvania, the law does not require a victim to testify at a preliminary hearing.
