LANCASTER CITY (WPMT)-Prosecutors are seeking the death penalty against Thomas G. Moore, one of the men accused of killing a Lancaster County elementary school teacher in December.

Moore, 25, and his alleged accomplice Marcus Rutter, 16,  are charged with homicide, involuntary deviate sexual intercourse, robbery,  burglary, criminal conspiracy, access device fraud, theft and receiving stolen property.

The pair are accused of killing 32-year-old Nicole Mathewson, a teacher at Brownstown Elementary School. Mathewson was found dead Dec. 15 inside her home on the 700 block of North Franklin Street. Prosecutors also allege the men sexually assaulted her before they killed her.

Because Rutter is 16, the death penalty is not an option for him under Pennsylvania law.

If Rutter is convicted, he could face life in prison with no chance of parole.
